The Enactorate of Urabbaparcensia Proprietary Limited (/ˈjʊərəbˌəpɑːsˈɛnsiə/ URE-a-bə-pah-SS-en-ss-i-ah), formerly Urabba Parks Pty Ltd, is a dominion of the Racservian Empire based in south-east Australia based around an overarching purpose "to advance humanity and the environment together" through charitable democracy. Urabbaparcensia was incorporated on 3 July 2012, registered as a charity on 3 December 2012, and adopted the current constitution on 5 March 2021. Urabbaparcensia is 3,335 m2 (35,900 sq ft) in area, encompassing 2 Urabbaparcensian sites in the Principality of New Eurabba.

Politically, Urabbaparcensia is a federal parliamentary constitutional monarchy, comprising the constituent micronation of New Eurabba and a registered office and interim capital in Melbourne. There is provision in the micronation's constitution for the admission of other regions and territories, being jurisdictional divisions with their own governance arrangements within the federal system. Subject to the legislative power of the corporate parliament, jurisdictional divisions are responsible for the affairs of Urabbaparcensia falling within the territory of their division, whether it be environmental protection activities on third-party properties or the governance of properties principally occupied by Urabbaparcensian entities falling in the division.

Etymology

The country name, Urabbaparcensia (/ˈjʊərəbˌəpɑːsˈɛnsiə/ URE-a-bə-pah-SS-en-ss-i-ah)Note 1, is the latinised version of Urabba Parks the original name of Urabbaparcensia. Incorrect spellings of the name include Eurabbaparcensia, Jurabbaparcensia, Yourabbaparcensia, Yurabbaparcensia, and the Electorate of Urabbaparcensia. Urabbaparcensia is colloquially referred to as the Urabbaparcensias, in reference to the landmass spanning over a number of sites rather than a single location, and is has also been referred to as the urban aparencias, a misspelling of urabbaparcencias. Urabbaparcensia adopted its current corporate name Enactorate of Urabbaparcensia Proprietary Limited under the Special Resolution Act 2024 assented to on 25 March 2024, and accepted by the Australian Securities and Investment Commission under the Corporations Act 2001 of the Commonwealth the next day, 26 March 2024.

Urabba refers to Urabba Street, where Urabba is located, and is a variation of the name of the nearby Parish of Eurabba in County of Bland, New South Wales. Eurabba is a Wiradjuri word meaning "a boggy creek".[1]

Parks refers to the operating model of "parks", which could include open spaces but also built environments for the purpose of providing charitable services such as health and education delivered by associated entities.

Designation

An enactorate is a polity ruled by an enactor or enactress, and in the case of Urabbaparcensia, by Danny Racovolis, the founding enactor.

Other legal elements

Proprietary (or Pty) refers to the fact Urabbaparcensia is a proprietary (private) company limited by shares under Australian company law. Although most charitable companies do not issue shares, and are incorporated as companies limited by guarantee, the Constitution of Urabbaparcensia provides for the surplus assets usually distributed among shareholders instead to be distributed to charities chosen by shareholders.

Limited (or Ltd) refers to the fact that under Australian company law, the members of Urabbaparcensia are not liable for its debts if the company winds up and is unable to pay them.

Demonym

Urabbaparcensia's official adjective or demonym is Urabbaparcensian. Urabbaparcensians are the people of Urabbaparcensia. The adjective Urabban applies to the Urabba Street Reserve site, while New Eurabban applies to the New Eurabba region.

History

The Wiradjuri have inhabited places associated with New Eurabba for approximately 65,000 years.[2][3] Permanent settlement at the current site of the village of Rankins Springs at the terminus of a railway line began in 1923. The founding enactor, Danny Racovolis, purchased 4 Urabba Street, a vacant quarter-acre block, in 2011.[Constitution 1] In early 2012, Racovolis decided to pursue what is now known in Urabbaparcensia as 'charitable democracy', having a charity nation delivering benefit to the wider community but also having a unique identity. Urabba Parks Pty Ltd was officially incorporated as a company on 3 July 2012, and was registered as a charity with the Australian Charities and Not-for-profits Commission on 3 December 2012.[4] The original quarter-acre bock at Urabba Street was declared Urabba Street Reserve by the local authority on 27 September 2016[5], allowing its marking on New South Wales map, and is now simply known as Urabba.

Establishment of jurisdiction

For the first 9 years of its existence, Urabbaparcensia was governed by a "conventional" charitable company constitution, which was slightly modified to allow for the fact it was a proprietary company limited by shares; any share of profits and assets to the shareholders would be prohibited to establish not-for-profit status. The current constitution came into force upon the establishment of jurisdiction on 5 March 2021, when the Urabba Parks Proprietary Limited Constitution Statute 2021 was officially enacted. The constitution provides that the overarching purpose of Urabbaparcensia is to "to advance humanity and the environment together"[Constitution 2] through the development of charitable democracy. The constitution also codified the micronational character as being both "Hellenic"[Constitution 3] and "Landcare".[Constitution 4]

Integration into the Empire of Imvrassia

On 23 June 2022, Urabbaparcensia became a Hegemony of the Empire of Imvrassia[6], a Greek micronation established by Emperor Aggelos in 2011 under the name Hegemony of Urabba Parks. The monarch now holds the honorary title of Sebastokrator of Urabba Parks. The affiliation to Imvrassia is intended to advance the Hellenic character of Urabbaparcensia. However, the arrangement was abolished along with the agreement with Flandrensis, on 1 May 2024.

Establishment of New Eurabba

On 14 August 2022, the Grand Duchy of Flandrensis announced the creation of an ecological sanctuary at Urabba,, now known as New Eurabba, under the terms of the Treaty of Corporation and Establishment of the Treaty on Corporation and Establishment of the Ecological County (Sanctuary) of Urabba, later renamed the Treaty on Corporation and Establishment of the Ecological County (Sanctuary) of New Eurabba. A treaty was signed on 18 August authorising the creation of the territory of Urabbaparcensia called the Flandrensian Ecological County of Urabba to be affiliated with Flandrensis as a sanctuary , while respecting the Traditional Ownership of the Wiradjuri people and the status of Urabbaparcensia as an Imvrassian Hegemony.[7] As a sign of appreciation, Emperor Aggelos made Grand Duke Nicholas an Archon of the Hegemony of Urabba Parks.[8] On 4 September 2023, the sanctuary was formally renamed the Flandrensian Ecological County of New Eurabba and established as a region of Urabba Parks Pty Ltd encompassing the surrounding local government electorate, Ward B of Carrathool Shire, New South Wales. On 8 September 2023, Urabbaparcensia acquired Promachos, a New Eurabban site, for the purposes of environmental protection. The treaty with Flandrensis was ended by mutual agreement effective 1 May 2024, with the region becoming a constituent micronation under the name Racservian Environment of New Eurabba.

Bodyguard Reform Package and other reforms

In 2024, Urabbaparcensia enacted the Bodyguard Reform Package which resulted in the creation of the Athena Urabbanakis Promachos Trust and officially adopted the name Enactorate of Urabbaparcensia Proprietary Limited. The Constitution was altered and the foundational statute renamed the Statute of Urabbapolis 2024.

Upon the request from the Urabbaparcensian Government, the Australian Government (through the Australian Charities and Not-for-profits Commission formed the Urabbaparcensian_ACNC Group in 2024 to represent Urabbaparcensia's charity sector before the macronational authorities. Members of the Urabbaparcensian ACNC_Group will lodge a common annual information statement each financial year in respect of the economy of the micronation.

In November 2024, the Racservian Environment of New Eurabba became the Principality of New Eurabba.

Geography and environment

Urabbaparcensia has two sites in New Eurabba, totalling 3,335 m2 (35,900 sq ft). Urabbaparcensia's registered office and interim capital in MelbourneNote 2. Online activities are taken to occur in Melbourne.

Section 116 of the Constitution of Urabbaparcensia provides that Urabbaparcensia's overarching purpose is "to advance humanity and the environment together" and also declares "that in honour of Australia and its Indigenous people," the micronation has a "Landcare" character.[Constitution 2] Urabbaparcensia is a member of Landcare NSW Limited, a peak body for Landcarers in New South Wales. The national colours of Urabbaparcensia are green and gold to represent the Australian environment, and are the colours of the flag of Urabbaparcensia, which was adopted along with the Constitution on 5 March 2021.

Urabbaparcensia has status in Australian law as Enactorate of Urabbaparcensia Proprietary Limited (formerly Urabba Parks Pty Ltd) as a company registered under the Corporations Act 2001 of the Commonwealth of Australia and incorporated in the State of Victoria. Urabbaparcensia is registered on the Australian Business Register (ABR) with the Australian Business Number 24 159 318 859[9]. The registered office of the company is in Melbourne. Urabbaparcensia is also a registered charity under the Australian Charities and Not-for-profits Commission Act 2012 of the Commonwealth and is regulated by the ACNC.[10]

Under intermicronational law, Urabbaparcensia was an Imvrassian Hegemony under the name Hegemony of Urabba Parks between 22 June 2022 and 1 May 2024. However, the arrangement did not have any impact on the law of the micronation, which remained effectively independent throughout the 'Hegemonic period'. As of July 2024, Urabbaparcensia was fully integrated into the Racservian Empire as a dominion.

Urabbaparcensia is governed by a Constitution, which establishes it as a "non-state jurisdiction" with its own legal system, a Parliament, Executive Government and Judicature. The jurisdiction is created by the agreement of jurisdiction, which is contained in subsection 7(2) of the Constitution,[Constitution 5] which provides that each party agrees to appear before judicial bodies in the case of "answering any charge of an offence against the law of Urabbaparcensia, or any appeals from any judgment, order or sanction so given in respect of a proceeding", and to public arbitration of matters arising under the law of Urabbaparcensia.

Monarchy

The monarch of Urabbaparcensia is The Representation of Urabbaparcensia, or The Management in Right of Urabbaparcensia. Succession to the Management of Urabbaparcensia depends of the holding of foundation in Urabbaparcensia, being the right to succeed the founder. The title of enactor derives from the role of the monarch as enacting component of the legislature, somebody who enacts laws. An enactorate is a polity ruled by an enactor. In formal documents and proceedings, an enactor is addressed as Mister Enactor in formal speech, while an enactress, being a female enactor or spouse of a male enactor, is referred to as Madam Enactor. Something that relates to an enactor is known as enactorial.

The monarch is an Honorary Manager and Honorary Director (a substantive appointment as a director despite the 'Honorary' designation) as well as Chairman. The monarch's designated representative in Urabbaparcensia by the Manager-General at the corporate level and by a manager at the divisional level, who by convention act on the advice of the ministers. Thus, in practice the Manager-General acts as a legal figurehead for the actions of the Park Minister and the Proprietary Council. The founder of the micronation, Daniel Racovolis, reigns as Enactor of Urabbaparcensia by virtue of holding foundation in Urabbaparcensia through his holding company D.J. Racovolis Services Pty Ltd, the Enactorial House of Racservia.

Federation and jurisdictional divisions

The Constitution establishes a federal system of government. Under a federal system, powers are distributed between a central government and constituent jurisdictional divisions. In Urabbaparcensia, that distribution is between Urabbaparcensia and its regions and territories. Urabbaparcensia has one non-territorial corporate jurisdiction, the Corporate Demesne of Urabbaparcensia, and one region with a physical location, the Principality of New Eurabba, originally established as a territory on 4 September 2022, established as a region one year later on 4 September 2023 and becoming a constituent micronation upon the adoption of the new terminology in the Constitution in mid-2024.

Parliament

Legislative power is vested in the Parliament of Urabbaparcensia (sometimes termed the Corporate Parliament) which consists of the monarch (represented by the Manager-General), the House of Ordinaries and houses established under the law of Urabbaparcensia.[Constitution 9] The corporate parliament has the power to make laws in many areas such as revenue items (membership fees, income levies from associated entities), external affairs, conduct of member proceedings and the management of entities formed within Urabbaparcensia.[Constitution 10]

Executive

Although executive power is nominally vested in the monarch and exercisable by the manager-general, the head of government in Urabbaparcensia is the Park Minister of Urabbaparcensia. The Executive Government of Urabbaparcensia consists numerous components,[Constitution 11] including:

Some agencies of the Executive Government are in the independent management service, with constitutional protection against removal by the responsible minister without the recommendation of the Parliament of Urabbaparcensia.

Judiciary

Each person who enters Urabbaparcensia or becomes a member is subject to the agreement of jurisdiction contained in the Constitution,[Constitution 5] which requires a person to appear when required as an accused or to give evidence to judicial bodies when required.

The judicial system is headed by the Court of Directors.[Constitution 12] The minister responsible for the judiciary is the Advocate-General, the Corporate Government's Chief Law Officer. The Directors of the Court are directors and charity trustees of Urabbaparcensia,[Constitution 8] and are appointed by the Manager-General in Council upon presentation of a member holding service membership (redeemable preference shares) of Urabbaparcensia.[Constitution 13]

The Parliament also has the power to create other courts, which also consist of judicial officers appointed upon presentation of service members with rights of presentation to the Manager-General in Council for appointment as a member of the court. In most cases the presenter is the judicial officer themselves, however in some cases another person or a company may present a qualified person for appointment. While the Manager-General in Council is not obliged to appoint a person so presented, the cessation of the presentation of an incumbent judicial officer by the presenter has the effect of ceasing the appointment.[Constitution 14] The Constitution provides for the admission of corporate advocates to the Urabbaparcensian Bar presented by a service member and of visiting advocates to represent parties to judicial proceedings in the courts.[Constitution 15]

Urabbaparcensian Governance Service

There is an independent governance service (known as the Urabbaparcensian Governance Service (UGS)) which is headed by the Visitatorial Commission,[Constitution 16] and includes other agencies such as Inquiries Urabbaparcensia (which conducts Enactorial Commissions, similar to Royal Commissions in Australia). Senior members of the Urabbaparcensian Governance Service are removable only with a vote of the Houses of the Parliament on the advice of the Visitatorial Commission. The Visitatorial Commission also reports to Parliament on its parliamentary performance in relation to adherence to Chapter 9 of the Constitution (including the Urabbaparcensian Bill of Rights), matters raised by the independent governance service, distribution of surpluses through charity distributions and matters referred to it by Parliament.

Foreign relations

Urabbaparcensia participates in the micronational community as a Hegemony of the Empire of Imvrassia under the name Hegemony of Urabba Parks, a status obtained on 23 June 2022.[6] The micronational diplomatic relations of Urabba Parks are the responsibility of the Emperor of Imvrassia. As a Hegemony, On 18 August 2022, Urabba Parks entered into a treaty establishing Urabbaparcensian sites within New Eurabba as an ecological sanctuary affiliated with the the Grand Duchy of Flandrensis[7].

Defence

The Urabba Parks Operations Network (UPON), which includes branches of the Urabbaparcensian Defence Service (UDS) and private services, contributes to the civil defence of Urabbaparcensia and its regional and global allies through environmental protection and rejuvenation, research and safety. UPON has designated branches in land, water, air, space and cyber spheres. The responsible minister for the UDS is the Minister of Operations who administers the Department of Operations which along with the UDS forms the Urabbaparcensian Defence Organisation.

Local government

District government of Urabbaparcensia is mentioned in the Constitution.[Constitution 17] A municipal district of Urabba Parks, the Urabba Street Reserve Committee, within New Eurabba, has local authority in the affairs of New Eurabba in the locality surrounding Urabba Street Reserve.

Economy

Urabbaparcensia is a company exempt from Australian income tax as a charitable institution as it is registered with the Australian Charities and Not-for-profits Commission.[10] As a registered charity, the company must be not-for-profit and work towards its charitable purpose, and must be able to demonstrate this and provide information about its purposes to the public. The main charitable object of Urabba Parks is to operate the Principality of New Eurabba for the benefit of the general public. The main activities of the company include Landcare and civil defence operations through the Athena Urabbanakis Promachos Trust, known as the Urabba Parks Trust.

Capital structure

Urabbaparcensia is limited by shares, meaning that the liability of members is limited to the amount (if any) unpaid on their shares. Most shares are issued 'paid up' with no such liability. This is in contrast with most charitable companies which are limited by guarantee and do not have a share structure. As of 8 September 2022, the sole member of the company is D.J. Racovolis Services Proprietary Limited (as the Enactorial House of Racservia).

In the capital structure of Urabbaparcensia, there are four types of membership:

  • Honorary membership (bonus shares), being paid up from retained earnings
  • Service membership (redeemable preference shares), being redeemable (i.e. repayable) to the shareholder for the amount paid up upon winding up or on the shareholder's request, with applications for redemption being placed in a redemption queue
  • Patron membership (non-redeemable preference shares), where the shareholder has the right to nominate the amount paid up on the shares to their chosen charity upon winding up
  • Ordinary membership, where shareholders are entitled to chose the charities to receive assets remaining net assets after the payment of debts (including those related to service membership) to their charities in proportion to their shareholding. Only voting ordinary members (who do not hold any right to succeed to the Management or any other title) may elect members of the House of Ordinaries.

Charity distributions

Urabbaparcensia is required to distribute its net assets after the payment of debts (including those related to service membership) to charities upon winding-up, and not pay any dividends. However upon dissolution the funds are divided among recipient charities nominated by ordinary members in proportion to their shareholding, subject to the special rights of patron members. In addition, there is a system in Urabbaparcensia, known as charity distributions, where by the company may declare an amount as a charity distribution, apply it to giving accounts and giving pools allocated to members. Funds in giving accounts and giving pools are then paid to charities nominated by the members.

Tourism

Urabba Street Reserve in Rankins Springs, New Eurabba (listed in some maps as the Enactorate of Urabbaparcensia Proprietary Limited, Racservian Environment of New Eurabba, Urabba Parks Pty Ltd and Urabba Street Landcare) is open to the public all days of the year, and a person may enter provided the person is not excluded, suspended or disqualified from the proceedings of Urabbaparcensia under Urabbaparcensian law. Although Urabba Street Reserve is open 24 hours a day, park users are advised not to loiter in or around the territory after dark or in the early hours of the morning as to avoid disturbing local residents.

The founder of Urabbaparcensia, Danny Racovolis, in honour of his grandfather J.P. Racovolis, declared in the constitution his intention the micronation has a Hellenic character in terms of ethnicity. Urabbaparcensia is affiliated with another micronation located in Greece, the Empire of Imvrassia, as a Hegemony. The affiliation with Imvrassia is intended to advance the Hellenic character of Urabbaparcensia. However, as an environmental charity, Urabbaparcensia does not have any permanent inhabitants of territory under its jurisdiction, and as such the private residences of Urabbaparcensians are not considered part of the micronation's integral territory. For the purposes of law of the Empire of Imvrassia, the population of the Hegemony of Urabbaparcensia consists of Racovolis as Sebastokrator of the Hegemony, along with other people declared by Urabbaparcensia to be part of its population.[11] The constitution provides for the declaration of Urabbaparcensian Associates, however membership of Urabbaparcensia is also required to vote in elections.

Many of the national symbols of Urabbaparcensia reflect the declared intentions of Danny Racovolis as founder of Urabbaparcensia. The house mark, the Urabbaparcensian Cross, is a is a monogrammatic cross or Staurogram (which is a typographic ligature composed of a superposition of the Greek letters tau (Τ) and rho (Ρ)), with the 'T' joined by a demi-circle. The Coat of arms of Urabbaparcensia is an emblem featuring a chevron of five Commonwealth Stars (of seven points) between three Urabbaparcensian Crosses, the crest is a glossy black cockatoo ducally gorged and holding in its dexter claw a branch of Olive proper, while the supporters by two human figures, namely a Athena Urabbanakis holding in her dexter hand a spade ensigned with the Plate of Representation, the symbol of the monarchy of Urabbaparcensia, and another human figure in corresponding attire.

Language

The main language of Urabbaparcensia is Urabbalish, a slightly modified version of Australian English, however in common with other English-speaking jurisdictions, the language does not have any status in the written law of Urabbaparcensia, being used by convention. There has also information relating to the micronation published in the Italian language.[12]

Religion

Under section 116 of the Constitution, the Parliament cannot mandate religious observance or a religious test for its members.[Constitution 18] However, the Constitution also designates an entity, the Church in Urabbaland, which claims to be under the spiritual jurisdiction of the Greek Orthodox Archdiocese of Australia, with St Paul the Apostle as the patron saint of Urabba Parks.[Constitution 19]

Culture and media

Urabbaparcensian culture is primarily an Australian culture, originally derived from United Kingdom but also influenced by the unique geography of Urabba Parks and the cultural input of Aboriginal and other Greek people. As an environmental organisation, Urabba Parks bases its culture in circularity, reusing existing materials and methods where practicable. Circularity is present in Urabbaparcensian art through the practice of reusing existing materials and methods, where practicable, in representing the contemporary nature of the Flandrensian Ecological County of Urabba in Rankins Springs and the aspirations of Urabbaparcensia as a micronation.

Urabba Parks operates the Corporate Register of Legislation, which provides links to Australian legal resources (in addition to providing authorised versions of Urabbaparcensian Government laws for download), in addition to a number of social media channels. Urabbaparcensian sport takes the form of involvement in fantasy leagues and tipping competitions. On 12 July 2022, Enactor Danny Racovolis entered Urabba Parks FC (now the Urabba Parks Cockatoos) in the 2022/23 season of the MicroNations League Trophy[13], a Premier League fantasy football competition, marking the involvement in intermicronational sporting competitions. On 15 August 2022, Urabba Parks was admitted as a member of the Micronationalist Martial Arts Association.[14] In 2023, Urabba Parks won the inaugural MicroAFL League Championship.[15]
