Preamble Foundation of the Kingdom of Bradonia
We the people, who reside within the Bradonian Realm, in order to guarantee our everlasting prestige and supremacy for endless ages, declare our rightful and lawful intention to establish this document that shall outline the law and order within the Bradonian Realm.
This document, under our authority and our authority alone, shall establish a strong and stable government, protect our national traditions, protect our national faith, and protect our culture for endless ages, whilst reinforcing and glorifying the divine and heavenly birthright of the serene and sacred monarchy, that rules this realm for all of eternity.
Therefore, it is within our intentions, that we the people, whom reside within the Bradonian Realm hereby ordain and ratify this constitution under the serene and divine authority of his Royal Majesty, Lord Bernhardt, the rightful King, and founding father of our Heavenly Realm.
Chapter I General Provisions
Article I: The Bradonian Realm is to be a Kingdom, and is to be officially referred to as the Kingdom of Bradonia.
Article II: The Kingdom of Bradonia is one and indivisible, and inviolable by nature.
Article III: The Kingdom of Bradonia is a sovereign, sacred and independent state, as defined by the Montevideo Convention of 1933.
Article IV: The English Language is to be the national language of the Kingdom of Bradonia and obligatory in the Bradonian Self-Defense Force alongside in all state and public institutions.
Article V: Presbyterian Christianity is to be the state religion of the Kingdom of Bradonia, and is to hold an everlasting supremacy within the state.
Article VI: Bravrina, is to be the capital of the Kingdom of Bradonia, tasked with hosting and maintaining the monarchy and her government.
Article VII: The Kingdom of Bradonia shall permanently maintain a hereditary-monarchical regime, under the rule of the House of Bernhardt or her cadet branches.
Article VIII: The Kingdom of Bradonia is a unitary state, all provinces, subdivisions and city states swear loyalty to the King, and the King only.
Article IX: Lord Bernhardt, is to hold the title of “Father of the Nation and of the Bradonians” indefinitely and perpetually.
Article X: Loyalty to the Bradonian Realm is a fundamental obligation of the Bradonian People and of the Bradonian Government
Chapter II The Crown
Article XI:The King of Bradonia, reigns and governs the Bradonian Realm on behalf of his own will, possessing within him absolute power and divine authority, in which sovereign power resides in.
Article XII: The King of Bradonia is the head of state and head of government of the Kingdom of Bradonia, possessing the powers and responsibilities of the executive branch, legislative branch, and judicial branch, all of which shall answer to him, and him only.
Article XIII: The King of Bradonia is sacred and inviolable.
Article XIV: The King of Bradonia serves as the spiritual head of the Presbyterian Church of Bradonia in accordance within the Presbyterian Church of Bradonia
Article XV: The King of Bradonia is responsible for defending the Presbyterian faith, and the rights of her people.
Article XVI: The Bradonian Throne shall be succeeded by the descendants of Lord Bernhardt, according to the provisions of the Bradonian Royal Succession Law.
Article XVII: The King exercises legislative power at the consent of his own will, and of his own ordinance
Article XVIII: The King ratifies and gives sanctions to laws, and orders them to be promulgated and executed, without his ratification, no laws can go into effect.
Article XIX: The King convenes the Royal Diet, opens, closes, prorogues it, and dissolves it at his own digression.
Article XX: The King appoints the Chancellor, the Vice Chancellor, the Lords of Parliaments, the Ministers, the Governors and the Lieutenant Governors, from among the members of the aristocracy, royalty and clergy at his own digression.
Article XXI: The King declares war, concludes peace, and negotiates treaties with foreign states.
Article XXII: The King possesses supreme command and authority of the Bradonian Self-Defense Force alongside her branches, the Bradonian Royal Army and the Bradonian Royal Navy.
Article XXIII: The King confers and revokes titles of nobility, ranks, orders, and other marks of national honor.
Article XXIV: The King orders amnesty, pardons, commutation of punishments, and rehabilitation.
Article XXV: A Regency shall be instituted in conformity with the provisions of the Bradonian Royal Succession Law and shall exercise the powers appertaining to the King in his name.
Article XXVI: The King possesses powers of the executive, legislative and judicial branches that are not explicitly mentioned in this document unless said powers are restricted by the will of law.
Article XXVII: The King's powers and responsibilities stated above are not revocable by the Bradonian Royal Diet or the Chancellor, his powers are eternal and inexorable by the will of the crown and of god.
Chapter III The Chancellor
Article XXVIII: The Chancellor of Bradonia is to serve as the appointed head of the Bradonian Royal Diet, alongside serving as the Lord President of the House of Peers and the Lord Presider of the Bradonian Royal Diet.
Article XXIX: The Chancellor, alongside his cabinet of nobles, oversees the functions and responsibilities of the Bradonian Royal Diet, on behalf of the King.
Article XXX: Only an Aristocrat, Royal or Clergyman, who has reached the age of 27, and holds a seat within the House of Peers may be eligible for Chancellorship.
Article XXXI: The Chancellor of Bradonia, as stated in Article XX, is to be appointed by the King, and is to serve at His Majesty's pleasure until either resignation or passing.
Article XXXII: The Chancellor is to lead a cabinet of nobles, who shall be responsible for overseeing the governance of certain aspects of the nation.
Article XXXIII: The Chancellor holds the right to appoint their cabinet, with the consent and approval from the King.
Article XXXIV: The Chancellor is to serve as a primary advisor of the King of Bradonia and holds the right to unrestricted access to the ear of the King.
Article XXXIV: The Chancellor holds the right to propose, debate, vote, and veto bills in the House of Peers, alongside the other lords of parliament.
Article XXXV: The Chancellor is to be ensured a seat in the Bradonian Privy Council.
Article XXXVI: The Chancellor may suggest and recommend ennoblements or pardons to the King.
Article XXXVII: The Chancellor is to be referred to as “The Most Excellent”
Article XXXVIII: In the case of tie between the Lords of Parliament, the Chancellor may use their right to veto the legislation, however they can not counter a veto from the King.
Article XXXIX: The Chancellor shall be held accountable by the members of the House of Peers, whereby a petition of three members of the House of Peers, to remove the Chancellor from office shall be put to vote in the House of Peers, however may be vetoed by the King.
Article XL: The Chancellor shall hold no immunity from prosecution in the event of being charged with a crime.
Chapter IV The Royal Diet
Article XLI: The Royal Diet is to be officially referred to as the “Serene Diet of the Most Honorable Lords and Peers in all of the Bradonian Realm”.
Article XLII: The Royal Diet is to be a unicameral legislature, consisting of one house, the House of Peers.
Article XLIII: The Royal Diet is headed by the Lord Presider of the Royal Diet and the Lord President of the House of Peers.
Article XLIV: The House of Peers is to be composed of five appointed members, two members of royalty, two members of nobility and one religious figure of the Presbyterian Church of Bradonia The member count of the House of Peers may be extended by the will of the King.
Article XLV: Lords of the House of Peers are required to hold a hereditary or life peerage, before being appointed into the House of Peers.
Article XLVI: Lords of the House of Peers, are to serve at His Majesty's pleasure until either resignation or passing.
Article XLVII: Political Parties and Political Associations are indefinitely barred from existing within the Bradonian Realm nor are they allowed to hold positions within the House of Peers.
Article XLVIII: All Lords of Parliament hold the right to vote in favor, to abstain or against a proposal in the House of Peers.
Article XLIX: The Royal Diet may suggest ennoblements or pardons of subjects to the King.
Article L: The Royal Diet may override the Chancellors veto by 3/5ths, however may not override a veto from the King.
Article LI: The Royal Diet is to not interfere with the will of the King nor is it to pass legislation without the consent and approval of the King.
Article LII: The House of Peers as a part of the Royal Diet may respectively present an address to the King.
Article LIII: If the Royal Diet or her members conduct themselves in ways considered undesirable to the King or the Chancellor, the Royal Diet can be dissolved for an indefinite amount of time by either authority.
Article LIV: Parliamentary session schedules are to be laid out by the Chancellor and shall be strictly followed throughout the session, after which, further proposals, bills, and subjects for discussion may be discussed. To gain a place in the schedule, a bill must be proposed at least 24 hours before the session.
Chapter V The Privy Council
Article LV: “His/Her Royal Majesty’s Most Serene Privy Council” shall be established as an advisory body for the King, with the purpose of advising the King on the governing and administration of the Kingdom of Bradonia.
Article LVII: The Privy Council is to be made up of Privy Councilors appointed personally by the King.
Article LVIII: All Privy Councilors must be ennobled before they take up their position in the Privy Council.
Article LIX: Privy Councilors are to be referred to as “The Honorable”.
Article LX: The Privy Council is to possess unrestricted access to the ear of the King.
Article LXI: The Privy Council holds the right to suggest ennoblements to the King.
Article LXII: The Privy Council is to be able to give the final say on a court appeal in the event that the Supreme Court may not have made the correct verdict.
Article LXIII: The Privy Council is to be the sole and principal advisory body for the King.
Chapter VI Human Rights
Article LXIV: The conditions necessary for Bradonian Subjectship are to be determined by law
Article LXV Any child born to parent(s) holding subjectship in Bradonia will be entitled to Bradonian subjectship by birth.
Article LXVI: No individual may be deprived of Bradonian Subjectship acquired by birth unless said otherwise.
Article LXVII: All Bradonian Subjects are to possess the fundamental right to life, beginning at conception, which is to be respected by both the Government and Medical Institutions.
Article LXVIII: All Bradonian Subjects are to be equal regardless of race, religion, sex, gender, or otherwise.
Article LXIX: All Bradonian Subjects are to possess freedom of sexual orientation.
Article LXX: All Bradonian Subjects are to possess the right marriage equality.
Article LXXI: All Bradonian Subjects are to possess the right to abortion.
Article LXXII: All Bradonian Subjects are to possess the freedom of migration.
Article LXXIII: All Bradonian Subjects are entitled to possession of private property.
Article LXXIV: Article XCIII: The right of property of every Bradonian Subject shall remain inviolate. Measures necessary to be taken for the public benefit shall be any provided for by law
Article LXXV: Except in the cases mentioned in the law, the secrecy of the letters of every Bradonian Subject shall remain inviolate.
Article LXXVI: All Bradonian Subjects may open up a civil court case in order to gain money in damages for injustices.
Article LXXVII: No Bradonian Subject shall be arrested, detained, tried, or punished, unless according to law.
Article LXXVIII: No Bradonian Subject shall be deprived of his right of being tried by the judges determined by law.
Article LXXIX :All Bradonian Subjects are to possess the right to a speedy trial, impartial jury, freedom from cruel and unusual punishment, and freedom from double jeopardy.
Article LXXX: Except in the cases provided for in the law, the house of no Bradonian Subject shall be entered or searched without his consent.
Article LXXXI: All Bradonian Subjects are to possess the rights to healthcare, food, and water.
Article LXXXII: All Bradonian Subjects are to possess the right to free education.
Article LXXXIII: Bradonian Subjects shall, within limits not prejudicial to peace and order, and not antagonistic to their duties as subjects, enjoy the freedom of religious belief and religious worship.
Article LXXXIV: Bradonian Subjects shall, within the limits of the law, enjoy the liberty of speech, writing, publication, public meetings, and associations, so long as they do not threaten the social or political integrity of the nation.
Article LXXXV: Bradonian Subjects living within Bravrina are amenable to the duty of paying taxes, according to the provisions of law.
Article LXXXVI: Bradonian Subjects may present petitions on non-political or government issues, by observing the proper forms of respect, and by complying with the rules specially provided for the same.
Article LXXXVII: Bradonian Subjects may, according to qualifications determined in laws or ordinances, be appointed to military offices equally based on merit
Article LXXXVIII: Bradonians Subjects are amenable to service in the Army or Navy, according to the provisions of law.
Article LXXXVIII: The provisions contained in the present Chapter shall not affect the exercise of the powers appertaining to the King, in times of war or in cases of a national emergency.
Article LXXXIX: Each and every one of the provisions contained in the preceding Articles of the present Chapter, that are not in conflict with the laws or the rules and discipline of the Army and Navy, shall apply to the officers and men of the Army and of the Navy.
Article XC: All Bradonian Subjects hold the right to refuse the quartering of soldiers.
Article XCI: All Bradonian Subjects hold the right to consent in accordance with the law.
Article XCIII: All Bradonian Subjects hold the right to start and regulate business within the nation in accordance with the law.
Article XCIV: All Bradonian Subjects hold the right to refuse the quartering of soldiers.
Article XCV: The Practice of the Death Penalty is to be outlawed and prohibited.
Article XCVI: The Practice of Child Labor is to be outlawed and prohibited.
Article XCVII: The Practice of Human Trafficking is to be outlawed and prohibited.
Article XCVIII: The Practice of Slavery is to be outlawed and prohibited.
Chapter VII Judiciary
Article XCIX: The Supreme Court of the Kingdom of Bradonia is to serve as the judicial authority within the nation, which answers to the King.
Article C: The Supreme Court is to be composed of 7 Justices approved and appointed by the King
Article CI: The Supreme Court is to handle all court cases that Provincial Courts fail to produce a verdict on.
Article CII: The Supreme Court is to hold final say on all legal matters, however, verdicts may be appealed to the Privy Council for a final say, in which a retrial can be ordered, or a verdict overturned.
Article CIII: Supreme Court Justices must be impartial in all matters of the Courts.
Article CIV: Provincial Courts are to be the principal judicial authorities of Provinces, in which the Justice is appointed by the Parliament.
Article CV: Provincial Courts are to handle all criminal cases and most civil cases.
Article CVI: Justices are to be subjected to the same rules and privileges as Supreme Court Justices.
Article CVII: Provincial Court Cases are to be decided via a trial by jury, in which the Jury is a group of six citizens randomly selected from the populace to help make the verdict impartially.
Chapter VIII National Symbols
CVIII: The Flag of the Kingdom of Bradonia is to serve as the flag for the nation, characterized by a Scandinavian Style Flag, with blue on the bottom, black on top with a white cross in the middle.
CIX: The Bradonian Flag is to be afforded respect, in which any violation of the flag is considered illegal by law.
CX: The National Animal of the Kingdom of Bradonia is to be the Dolphin.
CXI: The National Tree of the Kingdom of Bradonia is to be the Cherry Blossom Tree.
CXII: The National Flower of the Kingdom of Bradonia is to be the Violet
CXIII: The national motto of the Kingdom of Bradonia is to be “Bradonia Stands Strong Forever”
CXIV: “Bradonia Forever” is to be the national anthem of the Kingdom of Bradonia.
CXV: Other national symbols are to be established in accordance with the Bradonian National Symbols Act
Chapter IX Miscellaneous
Article CXX: The Kingdom of Bradoniain regards to her foriegn policy is to pursue an isolationist foreign policy in regards to foreign conflicts and is to have a “non-alliance in peace” and “neutrality in war” doctrine, and it is discouraged that Bradonia engages in foreign policy with other micronations.
Article CXXI: The Kingdom of Bradonia is to permanently ratify the Montevideo Convention, and under no circumstances is to recline or denounce the Montevideo Convention
Article CXXII: The economy of the Kingdom of Bradonia is to be social-democratic, in which a significant welfare state and social safety net exist while maintaining a free market connected to the American one.
Chapter X Amendments
Article CIII: Amendments to this Constitution shall be promulgated and executed by the King, at his own pleasure, and furthermore, holds the right to amend, reorganize or to add upon the current constitution, without the consent of the Bradonian Royal Diet.
Article CIV: Under no circumstances is this constitution nor her successors to support a government of republicanism or communism. In the unexpected case that the Bradonian Monarchy is to be abolished, the Bradonian Realm is to be abolished along with it, until the return of the monarchy is to be guaranteed.
Article CV: The article above is the only article not repealable, any attempts to unlawfully repeal it will result in the dissolution of the Bradonian Realm.
