His Majesty's Most Excellent Privy Council of the United Kingdom of Creek and Lake, known simply as the Privy Council of the United Kingdom of Creek and Lake, or the Privy Council, is the formal body of advisers to the Sovereign of the United Kingdom of Creek and Lake. The Privy Council was formed by the Royal Prerogative and is led one of the Great Offices of State and Realm, the Lord President, currently held by Patrick Kenny, Duke of Albany.

The Privy Council formally advises the Sovereign on the exercise of the Royal Prerogative powers and can issue executive orders known as an Order-in-Council, which usually act as secondary legislation empowered by an Act of Parliament. The Privy Council also advises on the issuing of warrants, charters and notices to individuals and groups. In theory, His Majesty's Government exercises its power on behalf of the Crown, though in practice this has been replaced by the Cabinet of the United Kingdom of Creek and Lake.

The Sovereign of the United Kingdom of Creek and Lake appoints all members of the Privy Council in consultation with HM Government.

History

The Privy Council was originally created as the Privy Council of the Sovereign Kingdom of Clear Lake on 25 January 2019 with the establishment of the nation. Its original role was akin to that of a government cabinet and advised the monarch on the powers and constrains of the law, and to also exercise the Crown's powers on behalf of it. This Privy Council was aided by the similar Privy Council of the Kingdom of Lake from 7 February 2019 and the Privy Council of the Kingdom of Creek from 14 March 2019. All three Privy Councils functioned in tandem and its various members were appointed thereunder separately.

By the passage of the Act of Union 2020, the Privy Council of the Kingdom of Creek became defunct. Later on, with the passage of the Second Act of Union 2020, the Privy Council of Lake also became defunct. From 15 November 2020, the Privy Council of the United Kingdom of Creek and Lake formed and remains the sole Privy Council to still be active.

Only the similarly named Imperial Council, tasked with the administration of the Commonwealth of Lacia since 14 September 2019, remained in operation, but only in a nominal capacity. It too was disestablished in January 2023, with remaining members being able to retain their precedence and style derived from it.

Functions

The functions of the Privy Council are established by tradition and by the Royal Prerogative. The members of the Privy Council discharge the duties assigned to them by the Sovereign. Among the functions of the Privy Council include:

  1. Deliberation on the passage of new bills of Parliament, along with any other secondary legislation and amendments to laws.
  2. Deliberation on the appointment of members of HM Government, including that of the Cabinet and other ministers.
  3. Deliberation on the appointments and commissions in the Royal Armed Forces.
  4. Undertake duties on behalf of the monarch and the Royal Family when required.

The Privy Council can also establish several committees for itself. In practice, these are called Royal Commissions as they are formed by Order-in-Council upon the will of the Sovereign.

There have existed several Royal Commissions in the past, e.g. the Royal Commission for the Union between the Sovereign Kingdom of Lake and the Kingdom of Creek between December 2020 and January 2021; the Royal Commission for the Union between the United Kingdom of Creek and the Kingdom of Lake in November 2020; the Royal Commission for Union with the Grand Republic of Cycoldia between June and November 2020 among others.

Composition

The Sovereign of the United Kingdom of Creek and Lake, when acting on the Privy Council's advice, is known as the King-in-Council or Queen-in-Council, depending on the sex of the reigning monarch.

The Sovereign may appoint any person as a Privy Counsellor, but in practice appointments are made with the advice of HM Government. The majority of appointees are senior politicians, ministers, senior members of the opposition party, senior politicians from member nations of the Commonwealth of Lacia, senior members of the Church of St Orr and other persons of eminent public distinction. Members of Royal Family are also regularly appointed as members. In practice, the Prime Minister, the principal secretaries of state, the senior officials of the Royal Household, the Private Secretary to the Sovereign, the Speaker of Parliament, the judges of the courts are regularly appointed to the Privy Council as well.

Members must subscribe to the Oath of the Privy Council and sign the Register of the Privy Council before they may officially be considered a member. There is no limit on the number of appointments to the Privy Council and not all are summoned to a meeting of the Privy Council.

The chief officer of the Privy Council is the Lord President, who is a Great Officer of State & Realm, as formally established later de jure by the Great Officers and Council of State Act 2023, who is usually also the Leader of the Lords and Ladies Spiritual and Temporal in Parliament.

Since Privy Counsellors are bound by oath to keep all matters discussed at meetings a secret, the appointment of senior members of the opposition enables cooperation between all political parties. This usually occurs when discussing sensitive political matters or those pertaining to national security.

Term of office

Membership to the Privy Council is conferred for life till the death or resignation of the appointee. By tradition, the Privy Council never undergoes dissolution even upon the demise of the Crown. The Sovereign can always expel a member of the Privy Council. Individuals can also resign from the Privy Council in order to avoid expulsion.

Rights and privileges

Individual members of the Privy Council are entitled to be styled as "The Right Honorable". Since certain peers, e.g. earls, also share a similar style, the placement of the post-nominal letters "PC" is enough to single them out as members of the Privy Council. For commoners, i.e. those who are not peers, the style of "The Right Honorable" is sufficient identification of their status.

All Privy Counsellors have the right to personal access to the Sovereign at all times for advice on public affairs. Privy Counsellors are accorded a formal rank in the order of precedence, if they already do not possess a higher one. At the beginning of a new session of Parliament, Privy Counsellors take the oath of allegiance before all other members in order of appointment. Privy Counsellors are also given priority to be heard in Parliament by tradition.

Oath

The Oath of the Privy Council is required to be taken and subscribed to by all new members before their appointment becomes effective. The text of the oath in full is as follows:

I, XX, do Swear that I will bear truth faith and allegiance to His Majesty King XX as One of His Majesty's Most Excellent Privy Council. That I will not in any manner attempt, do or speak out against His Majesty's position and honor. That I will faithfully and truthfully treat all matters discussed with my person to be kept in secrecy. And that I will keep to be truthful and faithful to His Majesty and to His Majesty's Most Excellent Privy Council.

Privy Counsellors can also affirm rather than swear upon their oaths. The oath taking ceremony is usually eschewed by Order-in-Council and in practice the oath is taken to be undertaken by the new appointee in lieu of a formal ceremony.
