The Monarchy of the Kingdom of Wellmoore, commonly referred to as the Wellmoorean Monarchy, is the constitutional form of government by which a hereditary sovereign reigns as the Head of State of The Kingdom of Wellmoore. The current, and first, monarch is King Luke of Wellmoore, who ascended to the throne in 2020 after founding Wellmoore.

The monarch and their immediate family undertake various official, ceremonial, diplomatic and representational duties. As the monarchy is constitutional, the monarch is limited to functions such as bestowing honours and appointing the Prime Minister, which are performed in a non-partisan manner. The monarch is also Commander-in-Chief of the Armed Forces of Wellmoore. Though the ultimate executive authority over the government is still formally by and through the Royal Prerogative, these powers may only be used according to laws enacted in Parliament and, in practice, within the constraints of convention and precedent. The Government of the Kingdom of Wellmoore is known as His Majesty's Government. However the monarch is issued executive power by the Wellmoorean Constitution but that power is used at the Monarch's discretion.

Constitutional Role

In the Wellmoorean Constitution, the monarch (also referred to as the sovereign or "His/Her Majesty" abbreviated to H.M./HM) is the Head of State. Oaths of Allegiance are made to the King and his lawful successors.

The monarch takes little direct part in government. The decisions to exercise sovereign powers are delegated from the monarch, either by statute or by convention, to ministers or officers of the Crown, or other public bodies, exclusive of the monarch personally. Thus the acts of state done in the name of the Crown, such as Crown Appointments,even if personally performed by the monarch, such as the King's Speech and the State Opening of Parliament, depend upon decisions made elsewhere:

  • Legislative power is exercised by the King-in-Parliament, by and with the advice and consent of the House of Lords and the House of Ministers.
  • Executive power is exercised by His Majesty's Government, which comprises ministers, primarily the Prime Minister and the Cabinet, which is technically a committee of the Privy Council. They have the direction of the Armed Forces of the Crown, the Civil Service and other Crown Servants such as the Diplomatic and Secret Services (the King receives certain foreign intelligence reports before the Prime Minister does).
  • Judicial power is vested in the various judiciaries of the Kingdom of Wellmoore, who by constitution and statute have judicial independence of the Government.

However the monarch is issued executive power by the Wellmoorean Constitution and may exercise that power at will but normally exercises that power on advice of the Prime Minister, Members of the Privy Council or a Cabinet Minister.

Appointment of the Prime Minister

Whenever necessary, the monarch is responsible for appointing a new Prime Minister (who by convention appoints and may dismiss every other Minister of the Crown, and thereby constitutes and controls the government). In accordance with unwritten constitutional conventions, the sovereign must appoint an individual who commands the support of the House of Ministers, usually the leader of the party or coalition that has a majority in that House. The Prime Minister takes office by attending the monarch in private audience, and after "kissing hands" that appointment is immediately effective without any other formality or instrument.


In a hung parliament where no party or coalition holds a majority, the monarch has an increased degree of latitude in choosing the individual likely to command the most support, though it would usually be the leader of the largest party.

Dissolution of Parliament

The monarch may dismiss Parliament at the request of the current Prime Minister or after a referendum that votes in favour of Parliament being dismissed.
After a Dissolution of Parliament happens, there will either be another election to re-elect a Prime Minister or the Monarch will take total control of the country until a new Prime Minister has been appointed.

Presidency of Tinakula

The Wellmoorean Monarchy also holds the role of Co-President of Tinakula, with the reigning monarch taking the office of Co-President.

History

Establishment

The Wellmoorean Monarchy was established on 14 March 2020 by His Majesty King Luke of Wellmoore, with the Wellmoorean Constitution reinforcing it's foundation.

Along with the establishment of the Monarchy, the House of Wellmoore was also founded and is still the ruling House with the Head of the House currently on the Wellmoorean Throne.

Succession

Upon the death of a sovereign, their heir immediately and automatically succeeds and the accession of the new sovereign is publicly proclaimed by the currently serving Prime Minister of Wellmoore. The monarch is usually crowned in Midnight Palace, normally by a religious figure. A coronation is not necessary for a sovereign to reign; indeed, the ceremony usually takes place many months after accession to allow sufficient time for its preparation and for a period of mourning.

Regency

When an individual ascends the throne, it is expected they will reign until death. However, if the monarch wishes to they may voluntarily abdicate if authorised by an Act of Parliament. The Regency Act of 2021 allows for regencies in the event of a monarch who is a minor or who is physically or mentally incapacitated. When a regency is necessary, the next qualified individual typically in the line of succession automatically becomes regent, unless they themselves are a minor or incapacitated.


During a temporary physical infirmity or an absence from the kingdom, the sovereign may temporarily delegate some of his or her functions to Counsellors of State, senior members of the Wellmoorean Royal Family or Senior Nobles.

The sovereign's official residence is to be Midnight Palace in Midnight City, Wellmoore's Capital City.

Style

The present sovereign's full style and title is "Luke of the Kingdom of Wellmoore".

The sovereign is known as "His Majesty" or "Her Majesty". The monarch also chooses his or her regal name, which doesn't have to be their first name.
