The Constitution of the Empire of Pacifico, also known as the Governing Document of the Empire of Pacifico, is the current governing document of the Empire of Pacifico. It has been in use since 11 June 2024, when it was ratified by the Emperor and Prime Minister. It has 4 Chapters, 15 Articles and 40 Sections. It is also the de facto first Act of Parliament.
Chapter I - Form of State and Government
Article 1
(1) Pacifico is an independent state in the form of an Imperial Monarchy.
(2) The Head of State is the Emperor, while the Prime Minister is the Head of Government and advisor to the Emperor.
Article 2
(1) The Governing body consists of the Emperor, Parliament and Senate.
(2) The function of the Emperor and Parliament is to lead the country executively.
(3) The function of Parliament is to create and propose new laws.
(4) Parliament can only make new laws with a ⅔ majority.
(5) The function of the Senate is to propose new alliances, review documents and approve the creation of new states and colonies.
Article 3
(1) The Emperor’s right is to lead the state in full. The Emperor also has the right to approve laws in full.
(2) The Emperor cannot be impeached.
Article 4
(1) The Prime Minister’s right is to assist the Emperor politically and to be accountable to Parliament and the Senate.
(2) The Prime Minister can only be impeached by the Emperor and a ¾ majority from Parliament.
Article 5
(1) The right of Parliament is to create laws with the Prime Minister.
(2) The Senate consists of Senators who preside over the administrative regions.
Article 6
(1) General Elections are held every year.
(2) The Prime Minister is elected by the people.
(3) The Prime Minister’s term of office is one year (after which he can be re-elected).
(4) All government positions must be held by Pacifican citizens.
Article 7
(1) If the Prime Minister dies, resigns or is impeached, an election may be authorised by the Emperor.
(2) If the Emperor is unsure whether to impeach the Prime Minister or not, a public vote can be authorised, by which people that are in favour of impeachment must receive a >½ majority.
Chapter II - Economy and Law
Article 8
(1) Pacifico’s currency is the British Pound.
(2) The government has the right to fully regulate the economy.
Article 9
(1) Law is carried out by the Supreme Court.
(2) Depending on the case, the Emperor may choose who the judge shall be for the Supreme Court.
Chapter III - Religion and Foreign Affairs
Article 10
(1) A religion can be recognised if the Emperor, Prime Minister, Parliament and Senate agree.
(2) Everyone who joins any religion, may not be forced or tortured to enter a different religion.
(3) Anyone who enters a religion that is not recognised by the state cannot be subject to any criminal penalties related to that religion.
Article 11
(1) The Pacifican Military is only to be put into use in case of an attack on Pacifican soil.
(2) The Emperor is the Supreme Commander of the Military.
(3) Pacifico’s military can attack if attacked by another country or group of people.
(4) Pacifico’s military is prohibited from carrying out a coup.
(5) War can be carried out with the consent of Parliament.
Article 12
(1) Diplomatic relations can be signed by the Emperor with confirmation from the Senate.
Chapter IV - Politics and Constitution
Article 13
(1) Political Parties may be created with Imperial consent, but it is advised to remain independent.
(2) Political Parties are prohibited from creating a rebellion.
(3) If a Political Party creates a rebellion, they may be disbanded.
(4) In this case, a rebellion means taking up arms against the government.
Article 14
(1) Arguments that happen in Parliament or Senate can only be resolved by the Imperial Court.
(2) The Emperor is the Imperial Judge of the Imperial Court.
Article 15
(1) Changes to this Constitution may be made in the form of an Amendment.
