The Supreme Court of the United Federation (SCOTUF), commonly the Supreme Court of Aumarea, is the highest court in the federal judiciary of the United Federation of Aumarea. It has ultimate appellate jurisdiction over all federal court cases, and over state court cases that involve a point of UF Constitutional or federal law. The court holds the power of judicial review, the ability to invalidate a statute for violating a provision of the Constitution. It is also able to strike down presidential directives for violating either the Constitution or statutory law.
The Supreme Court is overseen by the Chief Justice and all supreme court justices serve for life.
History
The supreme court was established as the continental supreme court on 4 March 2023, but was ordained as the Supreme Court of the United Federation after the adoption of the constitution on 12 March 2023.
Composition
Confirmation and Appointment
The constitution gives the right to appoint justices to vacancies in the supreme court to the president with the advice and consent of the senate. The Constitution sets no qualifications for service as a justice, thus a president may nominate anyone to serve, and the Senate may not set any qualifications or otherwise limit who the president can choose.
Jurisdiction
Congress is authorised by Article III of the federal Constitution to regulate the Supreme Court's appellate jurisdiction. The Supreme Court has original and exclusive jurisdiction over cases between two or more states but may decline to hear such cases.
The supreme court also has jurisdiction over constitutional cases and disputes. The supreme court also has some right to preside over some impeachment trials - with the constitutional role of presiding over presidential impeachments given to the Chief Justice.
Institutional Powers
The supreme court is given the ability to interpret the Constitution of Aumarea. As constitutional experts, the supreme court can declare laws as unconstitutional and block the legislative or executive from passing the law - this helps maintain checks and balances.
