The Parliament of the Kingdom of Eniarku is the branch of government with which legislative power resides in the Kingdom of Eniarku. It is a unicameral legislature, comprised of elected officials from each apportioned region of the country, and presided over by the king and, traditionally, the leader of the Council of State, the Lord President of the Council.
Members of Parliament (MPs) are elected to each apportioned area of the kingdom by general elections. The President of the Council of State, who typically runs the day-to-day affairs of the Parliament, is also appointed by the monarch and approved by a majority vote of the sitting Parliament. Much of the legislature is composed of nobility and high-ranking civil servants, who are elected by the constituents of their region. All elections use the first-past-the-post system, and current law does not impose term limits on members of Parliament. The last general election took place on 1 December 2016, when all nine members were formally reelected to Parliament's chambers.
Composition and powers
Parliament is the most powerful political entity in Eniarku. The legislative authority, officially vested in the Crown-in-Parliament, is composed of the Crown and the single chamber of the Parliament. Royal assent of the Sovereign is necessary for all Bills to become Acts of Parliament, while other legislation may be created independently by the monarch, including Orders-in-Council, which are a type of royal decree. The king also has executive powers which do not depend on Parliament, through prerogative powers, which include among others the ability to create treaties, declare war, award honors, and appoint officers and civil servants. In practice, however, these powers are almost always exercised by the monarch on the advice of the Council of State and other members of HM Government. The Prime Minister and government are directly responsible to Parliament by its control of finances and law, as well as to the people through the election of members of Parliament.
The monarch also traditionally appoints a Prime Minister, both to chair the Council of State and head the government. This individual is typically one who can effectively command a majority in a confidence vote in Parliament. The Parliament is formally styled The Right Honourable The Lords of Parliament Assembled, with members of the legislature being referred to as The Right Honourable Lord [Surname].
Judicial responsibilities
Under current Eniarkian law, there is no separate judiciary due to the infrequency of serious crime. Rather, the monarch appoints several members of Parliament (often referred to as Law Lords) as needed to serve as an ad hoc tribunal should crime occur, similarly to the judicial functions of the UK's House of Lords until 2009. After the trial concludes, these individuals rarely maintain permanent legal positions.
Membership and qualifications
Current law prescribes the following qualifications to become a members of Parliament:
- An individual must be at least 15 years of age;
- An individual must have been a citizen of Eniarku for no less than one (1) year;
- An individual must not currently hold citizenship of another micronation; and
- An individual must not have been convicted of serious crimes, either in Eniarku or their nation of origin.
