Government of Niestata
The Government of Niestata is the primary ruling body of the micronation Niestata. The government operates democratically and consists of a Parliament, a Senate,(both the legislative branch), a President (the executive branch), and a State Court (the judicial branch).[1] The Parliament is elected by the citizens of Niestata [2] and the President is elected by the members of Parliament (the President must also be a member of Parliament him/herself).[3] The President and members of Senate propose bills, acts, and laws,.[4][5] The Parliament and Senate vote on bills, acts, and laws to see if they pass, and something passed by Parliament but rejected by the Senate does not pass.[6][7] There are three branches of the Niestatan government—the Executive Branch, the Legislative Branch, and the Judicial Branch.
The Executive Branch
The President
The Executive Branch is solely consisted of the President, who is the Head of Government, Head of State, and Commander-In-Chief of Niestata. He/she is elected by the members of Parliament and must be a member of Parliament him/herself. The President can propose matters on which the Parliament and Senate vote. The current President of Niestata is Koshin DeNiestata.
The Legislative Branch
The Parliament
The Parliament of Niestata—along with the Senate—is the Legislative Branch of the Niestatan government. The purpose of the Parliament is to vote on bills/laws/acts proposed by the President or Senate member. It represents the public, as it is the only part of the government that is directly elected by the population. In turn, the Parliament elects the President and State Court.
If the population of Niestata exceeds seven citizens over the age of fifteen, the Parliament is consisted of seven members elected by the population. If under seven citizens over fifteen, the entire fifteen-plus population becomes the Parliament. Members are not representative of a certain region of Niestata; each citizen votes for all seven members of Parliament. Bad-behaving members of Parliament may be expelled from the legislature under certain circumstances.[8]
The Parliament is ideally located in the capital city of Chilisha, but currently exists in different parts of the world, connected by the internet.
The Senate
The second component of the Legislative Branch of the Niestatan government is the Senate. The Senate votes on all matters on which the Parliament votes, and is intended to act as a second opinion on all matters. Anything that is passed by the Parliament but rejected by the Senate is completely rejected. Additionally, members of Senate can propose bills/laws/acts, while members of Parliament cannot.
The Senate is consisted of two members from each registered political party, as chosen by the political party itself. There is no limit to the size of the Senate.
Ideally, the Senate operates in the same Legislative building as the Parliament.
The Judicial Branch
The State Court
All court cases in Niestata—criminal and civil—are resolved in the State Court of Niestata. It is made up of five qualified lawyers who are appointed by the Parliament. In all cases, the Court's settlement/punishment decision must be completely unanimous.
