The Firearms and Civilian Regulation Act 2021 was a article of legislation currently being created by the House of Representatives of the Arstotzkan Union in the House Select Committee on Civil Law. The act aims at regulating the ownership of certain firearms in the Arstotzkan Union in the bounds of the 2nd Article of the Constitution of the Arstotzkan Union. This act has led to the creation of the Federal Board of Firearms.

In 2023 the Arstotzkan Federal Congress added some provisions of the Act into the Armed Forces Act 2023.

Contents

The following is the current contents of the act as of May 24th 2022

Section 1: Class of Weapons and Firearms:

Article 1: This section shall disclose the difference (in Arstotzkan Law) of firearms that are deemed acceptable for civilian use and which firearms shall not be to be used by civilians and only to be used by the Arstotzkan Union Defense Forces. This shall be done through the establishment (by this act) of a Class-based system based upon the following conditions:

  • Size of the defining features of the firearm (such as barrel length, internal magazine capacity, etc…).
  • Size of the calibre used by the weapon (calibres are to be measured in both their known category, for example, .308 Winchester which is measured and known by that size compared to that of its metric size, being 7.62x51mm NATO)
  • Size of the Weapon (such as if it is deemed to be the size of a pistol it is classed as a pistol, however, if the firearm in question is larger than a standard pistol and uses a pistol calibre then it be designated a pistol).

Article 2: This act shall implement the Class of Weapons and Firearms (CWF) and shall be in regard to the previous criteria (in Article 1). The Classes are as follows:

  • Class 1 Firearm and Weapon (Pistols): These weapons are anything that uses, is chambered and fires a calibre between .22 Long Rifle and 9x19mm Parabellum. This weapon is to NOT fire faster than semi-automatic (that is defined by pulling the trigger and only ONE bullet fires.). Military Class 1 weapons are exempt from this condition unless stated otherwise by the Department of National Defense.
  • Class 2 Firearm and Weapon (Sub-Machine Guns): These weapons are anything that uses, is chambered and fires a calibre defined as a “Pistol Caliber”. For civilians, these weapons will be subject to requiring special criteria to be met before acquisition due to the weapon holding the ability to fire in full-automatic (that is defined by pulling the trigger and a continuous stream of bullets being fired). Military Class 2 Weapons are to be only used by Special Forces Units.
  • Class 3 Firearm and Weapon (Hunting Rifles): These weapons are anything that uses, is chambered and fires a calibre between .17 HMR and .45-70 Government. The largest calibre that can be used by Class 3 Firearms is .700 Nitro Express (comparable to 20x102mm Vulcan). No Military Rifle will be classified as Class 3.
  • Class 4 Firearm and Weapon (Assault Rifle): These weapons are anything that uses, is chambered and fires a calibre between 5.45x39mm and 7.62x39mm. These weapons must not be the property of any civilian and all Class 4 Weapons are to be the sole property of the soldiers of the Arstotzkan Union Defense Forces. Weapons in the Class 4 category may be either semi-automatic or full-automatic.
  • Class 5 Firearm and Weapon (Other Weapons): This Class shall contain any firearm that fires a calibre that does not match that of any of the previous classes. High powered rifle calibers (.458 SOCOM - .50 BMG),  

Section 2: Ownership, sale and purchasing of Firearms:

Article 3: This Act will permit the sale of firearms to civilians by authorized industries in accordance with Articles 1 & 2 of this act.

Article 4: This Act shall enforce that sale, ownership and purchasing of Firearms in the Independent Federal Republic of the Arstotzkan Union shall be subject to Article 2 of the Constitution of the Arstotzkan Union.

Article 5: No person under the age of 17 shall own or be in possession of a firearm in the Independent Federal Republic of the Arstotzkan Union, unless said weapon is owned by a citizen of New Zealand with authorized Firearm Ownership Licensing.

Article 5: No Firearms shall be imported to the Independent Federal Republic of the Arstotzkan Union without the knowledge of the Arstotzkan Federal Government and the established (by this act) Federal Board of Firearms.
