Article I (Declaration of Independence)
We the people of Arkonia unilaterally declare independence from the United States of America as of January the Twenty-Second, Two Thousand and Nineteen.
Article II (State Points)
§1
The reality of the Federal Republic of Arkonia(hereupon referred to as “Arkonia”) is lived out through its history and culture. Arkonians are a group of fun people that live out a country and do things that other, “real”, countries, do be that including tourism, government, and culture development.
§2
The long-form name of the country is the “Federal Kingdom of Arkonia” in the national language, which is English. The short-form name is “Arkonia”.
§3
The capital of Arkonia is Arkonia City.
§4
The sole language of Arkonia is English.
Article III (The High Assembly)
§1
The name of the uppermost house of the legislative branch of Arkonia shall be called the “High Assembly”, or “Assembly” for short.
Section I (Election)
§1
The High Assembly shall consist of one representative(“Senator”, as it shall be officially known) from each Alueet(subdivision) of Arkonia.
§2
Elections for the High Assembly shall take place at the same time as the elections for the House of Representatives.
§3
Senators must run for election in their home Alueet.
§4
If a Senator vacates their seat for any means, the chief executive of their Alueet must appoint a successor within a fortnight.
Section II (Composition)
§1
No senator will be required to vacate his/her office for any reasons.
§2
A Senator is considered “vacated” if he fails to vote at two or more consecutive sessions of the legislature, if he loses his/her citizenship, or if he/she dies.
§3
The Senate shall, after every election, choose a leader, who shall be known as the President of the High Assembly.
Section IV (Political Parties)
§1
Political Parties may operate under rules of their own design.
§2
A Political Party must register with the Federal Elections Commission to be able to run for any office.
§3
All political Parties must choose a color for their party.
Section V (House of Representatives)
§1
The House of Representatives has Fifteen seats, with the seats proportionally assigned by the amount of the populace that voted for a specific political party.
§2
Each Party will assign seats as it best sees fit.
Section VI (Passing Legislation)
§1
The words “Act” and “Bill” are ambiguous and can be used to mean either “act” or “bill”.
§2
A Bill must be submitted at least 2(two) days before the beginning of the legislative session.
§3
The Bill will be checked by Clerks, who will verify that it passes all the rules, as described in fue legislation.
§4
The members of the House and of the Assembly have until two days before the next session begins to submit their votes.
Section VII (The Prime Minister)
§1
The head of the Executive branch of the Arkonian government shall be the Prime Minister or “PM” for short.
§2
The Prime Minister shall be an elected member of the House of Representatives.
§3
The elected officials of the house shall, from time to time, vote for their leader, who shall become the Prime Minister of Arkonia.
§4
The Prime Minister will be out of his/her office as Prime Minister, but not as an elected representative, if he/she is voted out in a Vote of Confidence(VoC).
Section VIII (The Cabinet)
§1
The Prime Minister may appoint and dismiss members of the Cabinet as he/she sees fit.
§2
Cabinet Ministers advise the Prime Minister on issues related to their Ministry.
§3
The Internal Minister shall be responsible for all internal affairs, including intra-Alueet relations and certifying ballots after elections.
§4
The External Minister shall be responsible for correspondence with foreign nations.
§5
The Education Minister shall be responsible for working on educational developments for Arkonia.
§6
The Treasury Minister shall be responsible for managing the cash reserves of Arkonia.
§7
The Justice Minister shall be responsible for the courts in Arkonia.
§8
The Prime Minister shall appoint a member of the Cabinet to serve as the Deputy Prime Minister, an honorary position that only comes into effect when the Prime Minister can no longer serve in his position.
Article IX (Legislature Procedures)
§1
Both Houses of Congress(the legislative branch of Arkonia) must meet at least once a month.
§2
At the end of each legislative session, there will be a question on the ballot. It must say, “Do you wish for the current government to continue in its term of office?” If the number of votes in the “no” is greater than the number in the “yes”, then the Prime Minister shall be forced out of their position as the Prime Minister, but not as a representative.
Article X (Amendments)
§1
The Congress of Arkonia can amend the Constitution of the Federal Republic of Arkonia at any time.
§2
Any amendments must be approved by at least 4(four) of the 6(six) Alueets/Federal Districts and 75(seventy-five) percent of the populace.
Article XI (Courts)
§1
The judicial power of Arkonia shall be vested in one High Court and other inferior courts that Congress may from time to time establish.
§2
(1)The High Court shall be made up of five judges.
(2)All judges serve for a non-renewable term of eighteen years.
(3)Any Judge may serve as a trial judge brought before the judiciary.
(4)All judges are equal; however, the judge who has served the longest amount of time shall be known, ceremonially, as the “Chief Justice”.
§3
No Prime Minister, nor past Prime Minister, nor any public prosecutor, nor any representative in the Congress of Arkonia, shall be a Justice of Arkonia.
§4
When there is an exact precedent, the court shall rule according to law.
§5
If a judge or Justice is a party in a court case, he shall exempt himself from the bench for the duration of the case, and nominate a temporary replacement, who will be approved by the other judges or Justices of the court.
§6
The Court shall try persons for all offenses under the law, such as a person doing something he should not, or not doing something he should. The Court shall inflict such punishment as the law provides.
§7
The courts shall have the power to enforce penalties against violators, commensurate with the severity of the crime. The High Court may in certain extreme circumstances impose the penalty of expulsion from the country, by a unanimous vote. Sentences may only be overturned by Prime Ministerial Pardon.
§8
Any judge or justice may issue court orders or injunctions according to the generally accepted principles of Anglo-American law. These injunctions may order a party to perform his legal duty or may prevent the enforcement of a law which may be unconstitutional. Violation of an injunction is treated as contempt of court. The final arbiter of the organicity of injunctions is the High Court of Arkonia.
Article XII (Territorial Subdivisions)
§1
The Metropolitan area of Arkonia is hereby divided into 5(five) Alueets and one Federal District.
§2
The Alueets shall be known as Ware, Galym, Arkavia, Anatu, and Fürgava. The Federal District shall be known as Arkonia City.
§3
All Arkonian citizens belong to the province in which they live. Citizens living outside metropolitan Arkonia will be assigned to a province as prescribed by a future law.
§4
No citizen may be a citizen of more than one Alueet.
Article XIII (Citizenship)
§1
Citizenship can only be acquired through legal means.
§2
Residents of Metropolitan Arkonian territory are considered “residents” and are not entitled to be included in the political process of Arkonia.
§3
Citizenship must be applied by applying to the Undersecretary for Immigration in the Internal Department.
§4
Children whose parents were Arkonian citizens when they were born must simply notify the Undersecretary for Immigration when they turn 14(fourteen).
§5
Citizens do not need to live inside Metropolitan Arkonia to participate in the political process.
§6
Arkonians may, voluntarily or otherwise, renounce their citizenship if they wish.
§7
Any citizen who does not vote in two consecutive elections shall be deemed to have renounced his/her citizenship.
Article XIV (From the Kingdom)
§1
The Military of the Federal Kingdom of Arkonia shall be disbanded.
(1)If the Military is reinstated by future law, all logos and designs shall that were part of the Navy of the Federal Kingdom of Arkonia shall become the logos of the Federal Republic of Arkonia.
§2
The Current Prime Minister of the Federal Kingdom shall take over as the Transitional Prime Minister of the Federal Republic.
§3
All executive departments and independent agencies of the Federal Kingdom of Arkonia shall be shut down.
§4
All government-owned services shall transition to the ownership of the Federal Republic.
(1): The government-owned service, the “Federal Kingdom of Arkonia Gazette”, shall be shuttered, as the Federal Kingdom of Arkonia is no more.
Article XV (Miscellanea)
§1
All rights in the United Nations “Universal Declaration of Human Rights” shall apply on Arkonian territory.
Article XVI (Taking Effect)
§1
This Constitution will take effect after the people approve it by a two-thirds majority.
§2
If it is not approved by the prescribed amount, the Federal Kingdom of Arkonia will hold its position as the legitimate government of Arkonia.
§3
By the signing and approval of this document, all acts and bills of the Federal Kingdom of Arkonia are hereby repealed.
