The Constitution of Agatonia, legally known as the Agatonian Constitution, is the supreme law of Agatonia. It was adopted by the High Commonwealth Council on 18 August 2024, with further revisions about every 3 months. It is the fifth constitution in Agatonian history, following the Constitution of the People's Republic of Agatonia and the three other Constitutions of the Commonwealth of Agatonia.

The constitution is written in English and it consists of 1,161 words, forty-seven subarticles, seven articles and a preamble.

Preamble

We, the people and the Government of the Commonwealth of Agatonia do proclaim and establish this Agatonian Constitution of 2024, in order to do away with the previous problems that resulted in an undetailed constitution, and to redo the previous constitution to reaffirm details about the political structure and the human rights their citizens enjoy.

Article 1: The Commonwealth of Agatonia and their claims

a. This nation affirms the right of the Luijbregts-Namba family, to national self-determination as a group of people sharing a common ancestry and culture, living on the same area of land, and identifying themselves as a people and a nation. The 18 April 2023 Declaration of Independence is henceforth known as a valid and legal declaration of independence of the nation-state.

b. The Commonwealth of Agatonia is therefore hereby established as the People’s Republic of Agatonia, which declared full independence from the Netherlands as of 20:45 on 18 April 2023.

c. This constitution shall henceforth be known as the Agatonian Constitution of 2024.

d. All the claims of Agatonia (hereinafter referred as the Territories, Marches and Crown Dependencies) shall only be established by a legal act.

e. As of 28 May 2024, the Commonwealth of Agatonia consists of its mainland, the capital city of Kangarooville, New Washington, the Rockerfeller Islands, Eastern Ailsa Craig, Wittlin and Muslimmia.

f. President Kaito I shall hold the title “Founder of Agatonia” in perpetuity.

g. Administrative divisions in Agatonia shall be known as states. Subdivisions shall be known as prefectures or metropolitan cities.

h. Settlements shall be divided in cities, towns and villages.

Article 2: Titles given to government officials and succession

a. President Kaito I shall hold the title FCA, Founder of the Commonwealth of Agatonia.

b. Prime Ministers and Presidents succeeding President Kaito I shall hold the titles HOG (Head of Government) and LTP (Leader of the Politics). Prime Ministers and Presidents shall also hold the title HE (His Excellency).

c. The Head of State of the Commonwealth of Agatonia shall be the Monarch, known as the Emperor or Empress.

d. The Head of Government of the Commonwealth of Agatonia shall be the prime minister and president together.

e. Whenever a prime minister or president resigns, there must be democratic elections first. If the majority of the votes come out on a specific candidate, the candidate is directly given the role as the prime minister or president of the state.

Article 3: Government system

a.  The Commonwealth of Agatonia is a multiparty unitary parliamentary multiparty constitutional monarchy.

b.  Political parties shall be elected together with the prime minister elections. Majority votes determine who is the largest political party in the state.

c.  Every judge has the right to join political parties. This right should be kept inviolable.

d.  The title Imperial Savior is given to a government official that has done at least 5 duties in the nation-state.

e.  In this context, “duties” means doing something excellent in the country such as saving the country from a war.

f.  All government members are nominated or democratically elected by free and fair elections.

g. The legislative power is vested in the unicameral parliament, whose members shall be democratically elected on a half-yearly basis. The legislative body shall be vested in the High Commonwealth Council.

h. Executive, legislative and judicial power is mostly vested into the prime minister and president.

Article 4: The Monarchy

a.  The Commonwealth of Agatonia is a monarchy led by the Head of State, the Monarch. Currently, the Monarch is Empress Sachiko I.

b. Only the Monarch shall be eligible to hold the title HM (His or Her Majesty). No one else is eligible to hold this title.

c.  The Head of State does not have the supreme authority in the country. All the other government members should also be eligible to make decisions.

d. The person of the Monarch is sacrosanct and inviolable.

e.  The Monarch holds all of his or her rights, roles, responsibilities, privileges, and executive, legislative, and judicial powers through the holding of the Throne.

f.  The Emperor, if male, shall be known as “HM Emperor Forename”, and if female as “HM Empress Forename”.

g.  The spouse of the Monarch, if female, shall be known as “First Lady Forename”, and if male as “First Gentleman Forename”.

h.  The child of a Monarch, if male, shall be known as “Prince Forename”, and if female as “Princess Forename”.

i. Death or abdication of any Monarch shall always be hereditary. Successors of the Monarch shall be the youngest son of the Monarch.

Article 5: Crown Property

a. Crown Property is property that is owned by the Throne of Agatonia. This consists of all property owned by the Monarch by right of their holding of the Throne, and all property personally held by the Monarch, the latter of which for the duration of their reign shall be designated as Crown Property.

b. An abdicated or dead Monarch shall retain all Crown Property that became such due to their holding of the Throne.

c.  The Crown shall always stay in its place in the Royal Residence (1000 Greenwich Jct, Kangarooville, Postal code 111600), unless in the circumstance that there is a national event.

d.  The Crown may only be worn by the Monarch. No one else is eligible to wear the Crown.

Article 6: Political rights and civil liberties

a.  Every Agatonian national should be offered all their inviolable basic rights (hereinafter referred as human rights). Discrimination on all grounds shall not be permitted under all circumstances.

b.  The Agatonian Government recognizes the right to protest. This right should be kept inviolable under all circumstances.

c.  Every Agatonian national should have the right to free speech.

d. The Agatonian Government recognizes freedom of the press. This right should be kept inviolable under all circumstances, except in such a case that it violates the law.

e.  Everyone has the right to leave the country under all circumstances, except in such a case when the government restricts this right for purposes.

f.  Every Agatonian national has the right to political opposition. This right should be kept inviolable under all circumstances.

g.  The Agatonian Government recognizes freedom of movement. This right should be kept inviolable under all circumstances, except in such a case when the government restricts this right for purposes.

Article 7: Internet freedom

a. Every Agatonian national should be offered all their inviolable internet rights.

b.  All people in Agatonia shall have the right to freely search the internet without any interference from the government or political party.

c.  Internet freedom restriction should not be given by an authoritarian manner in such a way that it violates user rights.

d.  Any political party and the government should not block or filter, or compel service providers to block or filter internet content, particularly material that is protected by international human rights standards.

e.  All website or application restrictions should only be used for safety and safeguarding reasons.
