Constitution of the Baillium Empire

The Baillium Constitution, officially the Constitution of the Baillium Empire, is the supreme law of the Baillium Empire. The document was written by The Founder L. in early February 2019 and ratified on the 12 of February 2018. Including the title page, the document consists of 4 pages and is divided into a preamble, 8 articles spanning 18 Sections.
Preamble
We, the people of the Baillium Empire, having solemnly resolved to constitute Baillium into a secular unitary social democracy, to declare The Bailly Crater under our control and to secure to all of its citizens justice and equality hereby adopt this Constitution.
Article I
Section 1
All powers herein granted shall be vested in a Parliament which shall consist of a National Assembly.
Section 2
The National Assembly shall be composed of all Citizens of the State. The Vice Leader of the Bailium Empire shall be President of the National Assembly. The National Assembly and members of the Supreme Court shall choose The Supreme Leader.
Section 3
The Assembly may determine the Rules of its Proceedings and punish its Members for disorderly Behaviour.
Section 4
Every Bill which shall have passed the National Assembly, shall, before it become a Law, be presented to the Supreme Leader: If he approve he shall sign it, but if not he shall return it, with his Objections to the National Assembly, who shall proceed to reconsider it. If after such Reconsideration two thirds of the Assembly shall agree to pass the Bill it shall become a Law.
Section 5
The Assembly shall have Power, with a majority of its members, To pass rules that all citizens must obey; To define and punish Piracies and Felonies committed on the high Seas; To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water; To raise and support Armies; To make Rules for the Government and Regulation of the land and naval Forces; To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the Baillium Empire, or in any Department or Officer thereof.
Section 6
The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it. No Bill of Attainder or ex post facto Law shall be passed. No Title of Nobility shall be granted by the Baillium Empire: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.
Article II
Section 1
The executive Power shall be vested in a Supreme Leader of the Baillium Empire. He shall hold his Office during the Term of four weeks, and, together with the Vice Leader, chosen for the same Term, be elected, through a majority within the National Assembly on Friday and will begin their terms on the following Monday. In Case of the Removal of the Supreme Leader from Office, or of his Death, Resignation, or Inability to discharge the Powers and Duties of the said Office, the Same shall devolve on the Vice Leader, the Founders Council shall declaring what Officer shall then act as Supreme Leader, and such Officer shall act accordingly, until the Disability be removed, or a Supreme Leader be elected. Before he enter on the Execution of his Office, he shall take an Oath or Affirmation as established by the National Assembly.
Section 2
The Supreme Leader shall be Commander in Chief of the Army and Navy of the Bailium Empire; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to Grant Reprieves and Pardons for Offences against the Baillium Empire, except in Cases of Impeachment. He shall have Power, by and with the Advice and Consent of the Founders Council, to make Treaties, provided three fourths of the Founders concur; and he shall nominate, and by and with the Advice and Consent of the Founders Council, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the Supreme Court, and all other Officers of the Baillium Empire, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the National Assembly may by Law vest the Appointment of such inferior Officers, as they think proper, in the Supreme Leader alone, in the Courts of Law, or in the Heads of Departments.
Section 3
He shall from time to time give to the Founders Council Information on the State of the Empire, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he may, on extraordinary Occasions, convene both the National Assembly and the Founders Council, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper; he shall receive Ambassadors and other public Ministers; he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the Baillium Empire.
Section 4
The Supreme Leader, Vice Leader and all Civil Officers of the Baillium Empire, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors with a two thirds vote of the National Assembly.
Article III
Section 1
The Judicial Power of the Baillium Empire, shall be vested in one Supreme Court made up of three members. The Judges shall hold their Offices during good behaviour and shall not be part of any political party or hold any other position in government.
Section 2
The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the Baillium Empire, and Treaties made, or which shall be made, under their Authority;-to all Cases affecting Ambassadors, other public ministers and Consuls;-to all Cases of admiralty and maritime Jurisdiction;-to Controversies to which the Bailli\um Empire shall be a Party;-to Controversies between two or more Citizens, and foreign States, Citizens or Subjects. The Trial of all Crimes, except in Cases of Impeachment, shall be by Supreme Court.
Section 3
Treason against the Baillium Empire, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.
Article IV
Section 1
There shall be special powers granted to a Founders Council. These special powers are all the powers given to the Council by this Constitution.
Section 2
Their power shall extend to all those mentioned in this Constitution and the freedom to serve in any other office. This freedom is waived if they are appointed to the Supreme Court and will, upon confirmation, only be part of this Council and the Court. All decision made by the Council must be made with a majority of three votes unless otherwise stated.
Section 3
The Founders Council is to made up of the Four Founders L. A. N. D. and may not resign this office. No one else is allowed on this Council.
Article V
This Constitution, and the Laws of the Baillium Empire which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the Baillium Empire, shall be the supreme Law of the Land. The members of the National Assembly before mentioned and all executive and judicial Officers shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the Baillium Empire.
Article VI
The Supreme Leader, whenever they deem it necessary, shall propose Amendments to this Constitution, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by three fourths of the National Assembly, or unanimously by the Founders Council as the one or the other Mode of Ratification may be proposed by the Supreme Leader; Provided that no Amendment shall deprive the Founders Council of its special powers.
Article VII
Section 1
Political parties shall participate in the formation of the political will of the people. They may be freely established. Their internal organisation must conform to democratic principles. Parties that, by reason of their aims or the behaviour of their adherents, seek to undermine or abolish the free democratic basic order or to endanger the existence of the Baillium Empire shall be unconstitutional. The Supreme Court shall rule on the question of unconstitutionality.
Section 2
The Bailly Crater on Luna is the capital of the Baillium Empire. The National flag shall be split in half diagonally from top right to bottom left, with the left side Prussian Blue (#002664) and the right side Scarlett (#822433) with four white stars around the middle at a ninety degree angle.
Section 3
Until the provisions of Article VIII Section 3 is enacted then a citizen of the Baillium is: Individual born in the Bailly Crater; Individuals granted citizenship by as established by the executive department; Individuals born to citizens of the Baillium Empire.
Article VIII
Section 1
The Founders Council, with the participation of all members, shall confirm the ratification of this Constitution in public session and shall certify and promulgate it. This Constitution shall take effect at the end of the day on which it is ratified.
Section 2
The Founders Council shall also, if needed, be incharge of drafting and ratifying the Basic Rights.
Section 3
After there are more than fifty citizens, as described in act VII section 3, there shall be a second constitutional convention. The second constitutional convention shall be called and lead by the Founders Council. Done in Convention by the Unanimous Consent of the Founders Council present on the Twelfth of February in the year two thousand nineteen. In witness whereof we have hereunto subscribed our names.
