The Supreme Court of Vishwamitra (Hindi: विश्वामित्र सर्वोच्च न्यायालय) is the supreme judicial body of Vishwamitra and the highest court of the State of Vishwamitra under the constitution. It is the most senior constitutional court, and has the power of judicial review. The Chief Justice of Vishwamitra is the head and chief judge of the Supreme Court, which consists of a maximum of 5 judges and has extensive powers in the form of original, appellate and advisory jurisdictions.

As the apex constitutional court in Vishwamitra, it takes up appeals primarily regarding the safeguarding of fundamental rights of citizens and settles disputes between various authorities. As an advisory court, it hears matters which may specifically be referred to it under the Constitution by the Rashtradhyaksh.

History

The judicial branch of the government of Vishwamitra was established following the constitutional amendment of 6 December 2015. The Supreme Court came into existence the same day with Tanishkaa Patranabish becoming the first Chief Justice.

Jurisdiction of the Supreme Court

The Supreme Court of India was constituted as per Chapter VII of Part V of Constitution of Vishwamitra. The seventh Chapter of the Vishwamitran Constitution is "The Judiciary". Under this Chapter, the Supreme Court of Vishwamitra is vested with all Jurisdiction. As per Article 45, the Supreme Court of Vishwamitra had been constituted and established. The jurisdiction of the Supreme Court is specified under Article 46 which mentions that the Supreme Court shall have original jurisdiction in any dispute between the Government of Vishwamitra and one or more states, two or more states, etc.

Composition

The current composition as specified in Article 45 of the Constitution of Vishwamitra includes the Chief Justice and not more than four judges appointed by the Rashtradhyaksh. At the time of the creation of the court, it was only composed of the Chief Justice which was later expanded in 2019.
