The Preventative Measures Act 2022 is an important legislative document as a part of the legal framework of the Arstotzkan Union. The legislation became one of the most controversial pieces of legislation after it became the centre of the first major legal case in the history of the Arstotzkan Union.
Contents
The Act, as of 1 July 2022, has one section. The section relates to laws regarding the recognition of the Russian Federation, former USSR and former Soviet States.
Amendments
In late 2022 the Arstotzkan Federal Government amended the Preventative Measure Act to ban the Russian Language in the Arstotzkan Union and ban any aspects of Vladimir Putin's Russian culture in the Arstotzkan Union.
The Arstotzkan Federal Government did wind down some restrictions regarding the Arstotzkan Union's relationship with the former Soviet Union. On 1 September 2022, the former General Secretary of the Communist Party of the Soviet Union, Mikhail Gorbachev, was posthumously awarded with the Order of the Arstotzkan Eagle to symbolise his devotion to democracy and peace.
Controversy
Originally the Act had two sections but one was removed following a Supreme Federal Court case. Many in the Arstotzkan Union disagreed with the Federal Governments actions against the people of the CDG. Many people who were in the Arstotzkan Union were involved in someway. Many called for the law to be repealed by the Supreme Federal Court as it was immoral and violated the international rights recognized by the Constitution. However Chief Justice Ethan Brinkman stated that
Laws created that violate the rights of individuals that pose a threat to the national security of this state are moral and justified especially if they support the protection of the People of the Arstotzkan Union.
Because of this, a group known as the Confederate Legal Team subpoenaed the Arstotzkan Federal Government under Article 16 of the Constitution as they allowed for the legal and unjust discrimination of Confederate - Arstotzkan citizens. This case known as Confederacy v. Arstotzkan Union was brought to the Supreme Federal Court and became a landmark in Arstotzkan Judicial history as the Chief Justice ruled in favour of the Confederate Legal Team.
