The Arstotzkan Statute on Government Systems (2021) was the penultimate piece of supreme legislation in the Arstotzkan Union. The document was one of two articles of Legislation published on August 30, 2021. The document outlined the function and separation of the branches of the Arstotzkan Federal Government, and incorporated the political system of Arstotzkanism into the government. The document was also one of the articles of Legislation to use the 2021.8 version, which was an updated version from the 2021.1 version. This version aimed to make legislation more formal and improve it to international standards.

On 21 June 2023, the Executive Committee found that the Arstotzkan Statute did not properly outline the functions of government and also that the 2021.8 version of legislation was severely outdated in comparison to the 2023.6 version and so passed the Government Procedures Act 2023 which repealed the Arstotzkan Statute on Government Systems on 30 June 2023.

Amendments

2021 Amendment

The 2021 Amendment to the document changed the preface to inline with the newly created Article 40 of the Constitution of the Arstotzkan Union and was ratified on August 31, 2021.

2022 Amendments

The first 2022 Amendment was enacted on the grounds of the Executive Presidential Order 0007 and repealed Article 4 and amended Article 2.

The second 2022 Amendment to the document amended the preface to include the documents long title, as per the new parts of the new Legislation Version, 2022.3

The third 2022 Amendment came following the ratification of the Crimes Act 2022. These amended the statute and created the Federal judiciary and other courts outside of the Supreme Federal Court.

2023 Amendments

On 30 June 2023, the Arstotzkan Statute on Government Systems was repealed in favour of the Government Procedures Act 2023. This along with the Armed Forces Act 2023 removed all federal statutes and moved to only using Acts of Assembly.

Readings

The Arstotzkan Statute on Government Systems was read to the First Session of the Arstotzkan Federal Congress on 30 August 2021. It was approved by a 4-0 unilateral majority.

Contents

Article 1: The Arstotzkan system of Arstotzkan Governance shall be in line with the principles of Arstotzkanism. The government type of the Independent Federal Republic of the Arstotzkan Union shall be known as an Arstotzkanist Federal Presidential Constitutional Republic.

Article 3: The Arstotzkan Federal Government shall hold no power nor authority over the Office of the Presidency or any other Executive Branches (in line with Article 9, Section 4, of the Constitution of the Arstotzkan Union). This Article shall enforce that the Office of Presidency of the Arstotzkan Union shall be recognized as the Supreme Office of all areas of the Arstotzkan Union.

Article 4: [REPEALED], amended to Article 2 of this Act

Article 5: The Executive Committee of the Office of the Presidency shall operate in such a way that is of similarity to a Presidential Cabinet.

Article 6: The Political Bureau to the Executive Committee for the Arstotzkan Social Liberal Democratic Party shall operate in such a manner that is of similarity to a Party Caucus. The office shall only hold members of the Arstotzkan Social Liberal Democratic Party, the name of which can be shortened to the Politburo of the SDPPAU.

Article 7: Arstotzkan High Command shall be the authoritative union of the Departments and Command Councils of Arstotzkan High Command.

Article 8: The Arstotzkan Federal Government shall have no power over Arstotzkan High Command and the latter shall have no authority over the former.

Article 9: The Office of the Presidency shall be the Supreme Authority over both the Arstotzkan Federal Government (and its branches) and Arstotzkan High Command (and its branches).

Article 10: If any member of either the Arstotzkan Federal Government, Arstotzkan High Command or any of the Executive Branches is to create a document that requires a high level of Classification, the document shall only hold a legal privatized protection for a period of one year, six months from the date of either publication and/or approval.

Article 11: Legal documents such as legislation (created within the approval bounds of Section 6 of the Constitution of the Arstotzkan Union), the Constitution of the Arstotzkan Union, Military Documents, and the such, will not have to be translated into the approved languages (on a federal level) except into English. Unless they are to be sent to a foreign ally in a nation that uses a language that matches those used on a federal level.

Article 12: Government systems from the Arstotzkan Union, that were implemented prior to February 10, 2020, and have not been changed during the period known as the “Federalisation of the Arstotzkan Union” beginning on 14 October 2020 and finishing on 7 April 2021, must be updated to be in line with the philosophy and government systems of both Arstotzkanism and the current 2021 system.  

Article 13: The Arstotzkan Federal Government shall exercise size in accordance with the principles of Arstotzkanism as well as Democracy, Socialism, Republicanism, Transparency, as well as strive to fulfil the efforts of the establishment of a state that works on the best aspects of the Union of Soviet Socialist Republics and the United States of America. However, systems of Capitalism and Lenin-Marxist Communism shall not be used in this state.

Article 14: It shall be the duty of every member of the Arstotzkan Federal Government, Arstotzkan High Command, People's Armed Forces of the Arstotzkan Union, and other bodies of Government to respect and aid the Office of the Presidency in the protection of the nation and the Constitution for the continuation of the nation.

Article 15: Arstotzkan High Command shall exercise all methods appropriate to its ability for the protection of the Arstotzkan Union and the continuation of the Union.

Article 16: The Federal Assembly of the Arstotzkan Union shall operate the legislative houses of the Arstotzkan Union in terms of 359 days (360 days in leap years).

  • Section 1: The start day of the term shall be 5 January of each year.
  • Section 2: The end day of the term shall be 30 December of each year.
